California statute of limitations for personal injury
How long do I have to file an injury claim?
In California, the general deadline to file a personal injury lawsuit is two years from the date of injury (Code of Civil Procedure § 335.1). Exceptions exist. Claims against a government entity (for example, a city-owned parking structure or public road) generally require a written government claim within six months. Claims involving minors, delayed discovery of injury, or property damage can follow different rules.
This article covers California law only. Deadlines vary by state and by the facts, so speak with an attorney promptly. Waiting can also make evidence such as video footage and witness memories harder to obtain.
